February 24, 2021 Enforcement Committee Meeting Summary
Four members of the Enforcement Committee – Chair Scharff, Commissioner Gilmore, Commissioner Vasquez, and Commissioner Wagenknecht – attended the virtual February 24, 2021, BCDC Enforcement Committee meeting. The public was able to participate by submitting written comments by email prior to the meeting, by phone, or by accessing the meeting via a link posted on the Commission’s website. View only access was also provided via Facebook Live.
After approving minutes of the prior meeting, the Committee received an update on enforcement case resolution in 2021. As of February 18, 2021, staff has opened 22 new cases and closed 36 cases. The total caseload is 196 cases, down 15 cases from the 211 caseload as of December 31, 2020. After the enforcement report, Ms. Klein provided a progress report on the resolution of the oldest cases opened in 1999 or earlier, which included details provided in the written report that was distributed and posted on BCDC’s website.
Thereafter, Daryel Dunston, the City of Oakland’s Homelessness Administrator, provided an update on the City’s progress in complying with Cease and Desist Order No. CCD2020.001.00, which the Commission approved in October 2020 to address the situation in Union Point Park. Mr. Dunston informed the Committee that the homeless encampment at Union Point Park is in the process of being closed with occupants having agreed to relocate by the end of the week, and cleanup scheduled for next week. Mr. Dunston reiterated the City’s commitment to meet their obligations under Order No. CCD2020.001.00. Ms. Njuguna informed the Committee that the City requested and the Executive Director granted a 30-day extension for the requirement for full closure of the encampments at Union Point Park. She also noted BCDC’s ongoing commitment to ensure that the Park is restored and in a condition where it can be used by the surrounding community for the uses that were envisioned when the Park was created with public funds.

The next meeting of the Enforcement Committee is scheduled to be held from 9:30 AM to 12:00 PM on Thursday March 11, 2021. It is anticipated to also be an online-only virtual meeting with no physical location for attendees and participants to congregate.
