December 16, 2020 Enforcement Committee Meeting Summary

Three members of the Enforcement Committee – Chair Scharff, Commissioner Gilmore, and Commissioner Vasquez – attended the virtual December 16, 2020, BCDC Enforcement Committee meeting.  The public was able to participate by submitting written comments by email prior to the meeting, by phone, or by accessing the meeting via a link posted on the Commission’s website. View only access was also provided via Facebook Live.

After approving minutes of the prior meeting, the Committee conducted a hearing on the terms of a proposed agreement with the City of Sausalito to resolve the Richardson Bay matter.  The Enforcement Committee unanimously voted to recommend that the Commission authorize the Executive Director to sign an agreement documenting the City commitments described in the presentation, which are to (1) manage any vessel influx; (2) remove existing unlawfully moored vessels within five years; (3) cooperate in regional efforts to develop housing options; (4) mitigate existing damage to subtidal habitat and prevent and minimize any damage going forward; (5) continue existing waterfront management efforts; and (6) provide regular reports to BCDC Staff, the Committee and the Commission.  It is anticipated that an agreement with these terms will be presented to the full Commission at the meeting in January 2021 so that the Commission may authorize the Executive Director to execute the agreement.  At the meeting, City representatives stated that they agree with the terms, and one member of the public spoke against the action.

The Committee also received an abbreviated enforcement report briefing during which the Committee was informed that since December 9, 2020, one case was opened and one case which was a duplicative report of an existing case was closed, resulting in a current caseload of 230 cases, which is one less case than the caseload on December 9, 2020.  The Committee was also informed that the City of Oakland has been informed of the reported trash issues in Union Point Park and is working on trash removal at the encampment.  For details on the briefings, contact Priscilla Njuguna (415-352-3640, priscilla.njuguna@bcdc.ca.gov).

The next meeting of the Enforcement Committee is scheduled to be held from 9:30 AM to 12:00 PM on Thursday, January 14, 2021.  It is anticipated to also be an online-only virtual meeting with no physical location for attendees and participants to congregate.
