August 13, 2020 Enforcement Committee Meeting Summary

Three members of the Enforcement Committee – Chair Scharff, Commissioner Techel and Commissioner Vasquez – attended the virtual August 13, 2020, BCDC Enforcement Committee meeting. The public was able to participate by submitting written comments by email prior to the meeting, by phone, or by accessing the meeting via a link posted on the Commission’s website. View only access was also provided via Facebook Live.

At the meeting, the Committee received three briefings. The first briefing focused on the enforcement program case resolution progress since July 1, 2020 and informed the Committee that there are 257 open cases, 13 new cases have been opened and 15 cases have been closed. Ms. Njuguna also reported that interviews have been completed to backfill the open enforcement staff position.

As part of the enforcement report Ashley Tomerlin, Bay Design Analyst, provided a brief summary on the temporary public access closures that have been allowed where permittees are able to demonstrate a need to close areas to comply with local public health orders and limit public gatherings where social distancing is not possible.

In the final briefing, Ms. Donovan presented the revisions to the proposed Cease and Desist Order for Union Point Park that staff negotiated with the City of Oakland. Staff recommended approval of the revised uncontested Order, which would establish dates for clearing the Park after the COVID-19 emergency ends and restoring it to the conditions described in the permit. The Committee unanimously voted to approve the Order and recommend that the Commission adopt it. City of Oakland representatives spoke at the meeting to provide an update on the current Park conditions and the ongoing challenges that the City faces in clearing the Park of homeless encampments and remedying the damage that has been done to the Park.

The next meeting of the Enforcement Committee, which is planned to be a special workshop, is scheduled to be held from 9:30 AM to 12:00 PM on August 26, 2020. It is anticipated to also be an online only virtual meeting with no physical location for attendees and participants to congregate.
