February 16, 2017 Enforcement Committee Meeting Summary

5 members of the Enforcement Committee attended the February 16, 2017 BCDC Enforcement Committee meeting, which was held at the Metro Center Regional Headquarters Building in San Francisco.

The Committee adopted on a vote of 4-1 a motion to adopt a modified recommended enforcement decision involving proposed Cease and Desist and Civil Penalty Order No. CDO 2017.01 for alleged violations at the Public Pavilion at Scott’s Seafood Grill and Bar, located within Jack London Square in the City of Oakland, Alameda County. The Committee adopted the Executive Director’s recommended enforcement decision with modifications, including recommending that the Port of Oakland be removed from the proceeding and that the proposed penalty of $841,180 be reduced to $395,360. Due to a lack of time, the Committee did not hold a public hearing on the recommended enforcement strategy nor receive a staff briefing on enforcement work.

The next Enforcement Committee meeting will take place on March 16, 2017. The Committee will hold a public hearing and discussion of the recommended enforcement strategy and receive a staff briefing on enforcement work.

The Enforcement Committee’s recommended enforcement decision involving proposed Cease and Desist and Civil Penalty Order No. CDO 2017.01 will be considered by the Commission at its meeting on April 6, 2017.
